Accredited Sponsor

If you are considering applying for a Standard Business Sponsorship (SBS) or need to renew your current SBS then it may be worth checking if you are eligible to apply for Accredited Sponsorship. Becoming an accredited sponsor has its benefits, especially if your business regularly sponsors through the TSS Visa scheme.

Benefits of becoming accredited

The main advantages of being granted accredited sponsorship are:

  • Priority processing for all nomination and TSS Visa applications
  • Streamlined processing for low-risk TSS nomination applications
  • Labour Market Testing (LMT) may be met through advertising on the company website

For most businesses a faster processing time is the biggest drawcard. The faster your application is processed the faster your sponsored worker can start working for you. Current applications for a standard sponsor are taking 35-75 days to process whereas most applications by an accredited sponsor are processed within five days. 

Streamlined processing may be applicable to low-risk nominations that are lodged. These generally include occupations with an ANZSCO skill level 1 or 2 and with a minimum salary of $90,000 or $180,000.

When lodging your nomination application you need to prove you have met the LMT requirements. Unlike standard sponsors advertising job vacancies on your company website will be accepted (as long as the advertisements can be accessed by the general public).

Who can apply for Accredited Sponsorship

In order to be granted accredited status you must first meet the requirements for becoming a Standard Business Sponsor and then all of the requirements for one of the categories below:

·      All of your Australian employees are paid in accordance with an Enterprise Agreement or internal salary table which meet current market salary rates for all occupations you employ low volume usage of the 457 and TSS visa scheme and your business employs a high percentage of Australian workers

·      At least 85% of your workforce is Australian workers

·      At least one nomination has been approved within the last year for a 457 or TSS visa holder

·      More than 97% of your nomination applications have been approved (within the last year)

·      You’re not a partnership or sole trader

·      Over the last two years your annual turnover has been at least AUD four million

·      You’ve been a standard business sponsor for at least 12 months and complied with all sponsorship obligations

·      All of your Australian employees are paid in accordance with an Enterprise Agreement or internal salary table which meet current market salary rates

·      You have written contracts for all 457 and/or TSS visa holders. These contracts must meet National Employment Standards (unless the occupation is exempt)High volume usage of the 457 and TSS visa scheme and your business employs a medium percentage of Australian workers

·      At least 10 nominations have been approved within the last two years for 457 or TSS visa holders

·      More than 97% of your nomination applications have been approved (within the last two years)

·      You’re not a partnership or sole trader

·      Over the last two years your annual turnover has been at least AUD four million

·      You’ve been a standard business sponsor for at least 12 months and have complied with all sponsorship obligations

·      All of your Australian employees are paid in accordance with an Enterprise Agreement or internal salary table which meet current market salary rates

·      You have written contracts for all 457 and/or TSS visa holders. These contracts must meet National Employment Standards (unless the occupation is exempt)

Police checks for sponsored applicants

Applicants applying for a TSS Visa are required to provide police clearance certificates for any country they have lived in for more than 12 months collectively over the last 10 years.

As an accredited sponsor any applicant you wish to sponsor will not need to provide police clearance certificate except for Australia (if applicable). Instead you are able to write a Sponsor reference. Be aware that your accreditation may be revoked if it becomes apparent that the sponsored employee or family members included has a criminal conviction from another country. If you would rather not provide a sponsor reference the applicant can apply for police certificates as normal.

How long is it valid for and what are my obligations?

The SBS accreditation may be approved for 6 years, a year longer than the SBS, allowing you to sponsor as many employees through the TSS visa scheme. You will have the same obligations as a standards business sponsor.

How much does it cost?

There is no extra cost to become accredited. The cost is the same as an SBS application ($420). Saying that, if you are already a SBS, you will need to lodge a further SBS application to become accredited and pay the associated application fee.

Accredited sponsorships can be quite complicated and require a number of documents. Using a Registered Migration agent is optional. Their professional fees vary depending on the agent or agency but a rough guide would be between $1,800 and $2,500.

Summary

Accredited sponsorship can be very advantageous for companies who sponsor a number of overseas workers thought the TSS visa scheme or are time sensitive when lodging applications.
