Do Caveats Apply To Your Business?

Everything you need to know about caveats for the TSS visa subclass 482

If you’re an (overseas candidate) (employer) considering (migrating to Australia) (sponsoring an overseas worker) on a TSS visa (subclass 482), caveats could play a vital role in whether that is possible or not for you.

Currently the DHA has implemented caveats on 112 occupations, so its worth checking which occupations are effected in case they relate to you.

What is a caveat?

A caveat is fundamentally a condition or additional requirement that has been added to an occupation. This generally happens when an occupation is broad or difficult to define and are designed to ensure skilled visa programs are used to fill skilled positions that cannot be filled via the local labour market. Caveats identify more specific requirements related to an occupation, and if these are not met will result in a refusal of the visa and nomination application.

STSOL occupations with caveats

The following are all of the occupations on the Short-term Skilled Occupation List (STSOL) that have caveats. What happens if the occupation you want to nominate has a caveat? 

This depends on what the caveat is and how it affects your ability to sponsor overseas workers in a particular occupation. Unfortunately for the majority of caveats there are no exemptions. Complying with caveats will either be achievable or not and based on the circumstances of your business and the position you wish to nominate. The only exemptions are with caveats that state if the nominee is an intracompany transfer (ICT) to which an International Trade Obligation (ITO) applies. However in some situations there is some flexibility in how the caveats are interpreted. Therefore if you are ever unsure we recommend getting professional advice from a Registered Migration Agent who will be able to assess your situation.

Some caveats are well within your control such as caveats stating what the minimum salary must be paid. It’s your choice if you are willing to pay the specified rate and if not then sponsoring will not be an option. Others may be achievable but could mean adapting the job role or how the business operates, this may or may not be an option for your business. When adapting a position to satisfy a caveat you must also be mindful that the position must be genuine.
